The Delhi High Court has granted permission to a 16-year-old rape survivor to terminate her 31-week pregnancy, according to reporting by The Hindu — National. The ruling provides judicial clearance for the medical procedure despite the advanced stage of gestation.
Statutory Limits and Judicial Relief
Under India's Medical Termination of Pregnancy Act, abortion is generally permitted up to 20 weeks of gestation in ordinary circumstances. The law allows for an extension up to 24 weeks for specific vulnerable categories, which explicitly includes survivors of sexual assault and rape.
Because the petitioner's pregnancy had reached 31 weeks, the statutory ceiling barred access to a standard procedure without a direct court intervention. The High Court evaluated the exceptional circumstances surrounding the minor's case before granting the necessary approval for medical practitioners to proceed.
Medical Clearances and Circumstances
The court's authorization enables the minor to access clinical termination under appropriate healthcare supervision. Standard legal frameworks in India require judicial orders when pregnancies exceed the 24-week statutory boundary, with judges typically considering the petitioner's physical well-being, mental trauma, and the circumstances under which the conception occurred.
The ruling directs medical facilities to carry out the termination while managing the risks associated with ending an advanced pregnancy in a minor.
